Customer Service

The most important points in brief

  • These terms and conditions govern the purchase of goods through hatstore.co.uk. Your contract is with Hatstore World AB (“Hatstore”, “we”).

  • The language of the contract is English. You will receive an order confirmation by e-mail.

  • You have a statutory 14-day right to cancel (clause 9). In addition, we voluntarily give you a 100-day right of return (clause 10).

  • Your statutory rights remain unaffected (clause 11).

1 Scope and definitions

1.1 These terms and conditions apply to all orders placed by consumers through hatstore.co.uk. Our online shop is aimed exclusively at consumers.

1.2 A consumer is an individual acting for purposes that are wholly or mainly outside that individual’s trade, business, craft or profession.

1.3 Any different terms put forward by a customer apply only if we have expressly accepted them; acceptance by e-mail or on another durable medium is sufficient.

2 How the contract is formed

2.1 The presentation of products in the online shop is not a binding offer, but an invitation to you to make an offer to buy.

2.2 You can add products to your basket without obligation. You can change your details at any time before submitting your order by using the correction options provided during the ordering process.

2.3 By clicking the “Pay order” button, you make a binding offer to buy the goods in your basket. The contract is formed only when we confirm your order with an order confirmation sent by e-mail or, at the latest, when we dispatch the goods to you.

2.4 If you are under 18, you may only place an order within the limits of your legal capacity or with the consent of a parent or guardian.

3 Language of the contract and storage of the contract text

3.1 The language of the contract is English.

3.2 We will send you an order confirmation with your order details by e-mail. The current version of these terms and conditions is always available at hatstore.co.uk/info/terms-and-conditions, where it can be saved and printed. The version that applies to your order is the one published at the time you placed it.

4 Prices

4.1 All prices on hatstore.co.uk are final prices in pounds sterling (GBP) and include UK VAT.

4.2 Delivery charges may apply in addition to the purchase price. They are shown on the order summary page before you submit your order.

4.3 The price shown in the shop at the time of your order applies.

4.4 Pricing errors and lack of stock.

(a) Pricing errors. If a price shown in the shop is based on an obvious typing, printing or transmission error and you should reasonably have noticed this, we are entitled to cancel the contract. In that case we will inform you immediately, and at the latest within seven working days of receiving your order. We will refund any payment already made immediately, and at the latest within 14 days of our notification, in full and using the same payment method you used for the order. You may instead choose to continue the contract at the corrected price.

(b) Lack of stock. If the goods you ordered are no longer available after the contract has been formed, we will inform you immediately, and at the latest within seven working days of receiving your order. We will refund any payment already made immediately, and at the latest within 14 days of our notification, in full and using the same payment method you used for the order. Your statutory rights are not affected.

5 Payment

5.1 When you make a purchase, you enter into separate agreements with our checkout and payment partners. The contract of sale for the goods is always with Hatstore World AB. Through our provider Kustom AB, Sturegatan 6, 114 35 Stockholm, Sweden, we offer a checkout that gives access to various payment methods. When you make a purchase, you also enter into an agreement with Kustom AB; see its terms here. Payment methods may change over time and are provided by different payment service providers, for example Klarna Bank AB. If you choose a Klarna payment method, you enter into an agreement with Klarna Bank AB; see the terms for the relevant payment method at www.klarna.com/uk.

5.2 The payment methods available in each case are shown at checkout. More information on how payment service providers process personal data can be found in our privacy policy (clause 13).

5.3 The purchase price is due when the contract is formed, unless stated otherwise for the payment method you choose.

6 Delivery

6.1 We deliver to addresses in the United Kingdom. Goods are dispatched from our warehouse in Kalmar, Sweden.

6.2 The delivery time is shown at checkout before you submit your order. Further information on delivery times, for guidance only, is available at hatstore.co.uk/info/delivery. If this information differs from what is shown at checkout, the delivery time shown at checkout applies.

6.3 Delivery charges depend on the order value, the delivery address and the delivery method you choose. The delivery charges for your order are shown at checkout before you submit your order.

6.4 The delivery method (for example home delivery, delivery to a pick-up point or a parcel locker) depends on the option you choose at checkout and is shown before you submit your order. The carrier will tell you separately about its delivery and collection terms, including any collection deadlines. The goods are at our risk until you, or a person you have nominated, take physical possession of them.

6.5 Uncollected or undeliverable parcels.

(a) If a parcel cannot be delivered or is not collected and is therefore returned to us, we will try to contact you by e-mail. You then have 5 days to ask for redelivery. We will pay for the redelivery unless the original delivery failed for reasons you are responsible for (for example an incorrect delivery address or failure to cooperate with the delivery). In that case we will tell you the cost of redelivery in advance and charge it only with your express consent.

(b) If you do not ask for redelivery within 14 days of our contact, we will cancel the order and refund the purchase price. If the parcel was not collected, or the delivery failed for reasons you are responsible for, we will deduct a handling fee of £15 from the refund to cover our handling and return shipping costs. You may show that our costs were lower. Not collecting a parcel does not count as cancelling the contract; if you wish to cancel, please tell us in accordance with clause 9.

(c) Personalised products. If you were unable to receive personalised products that are excluded from the right to cancel and the right of return (clause 9.6) and they are returned to us, we will keep them for you for 2 months from our notification under the next paragraph.

When we receive the returned goods, we will e-mail you at the address given with your order to tell you that the goods have been returned, how long we will keep them and what options you have under the next paragraph. No separate reminder is sent before the storage period ends.

During the storage period you can:

  • ask for redelivery (we pay the costs unless the delivery failed for reasons you are responsible for); or

  • collect the goods yourself from our warehouse in Kalmar, Sweden.

After the storage period has ended, we are entitled to dispose of the goods appropriately. Any proceeds from a sale will be paid to you after deducting our documented storage and handling costs.

6.6 In the event of circumstances beyond our reasonable control (for example natural disasters, power failures, strikes or decisions by public authorities), delivery times are extended for the duration of the event. If, in such a case, you cannot receive the goods within a reasonable additional period, you are entitled to end the contract; any payment already made will be refunded in full. Your statutory rights are not affected.

7 Ownership

7.1 The goods remain our property until they have been paid for in full.

8 Personalisation and copyright

8.1 For selected products, you can have your own personalisation applied using our Custom Made tool. The products, techniques and design areas available, and the technical specifications that apply, are shown in the Custom Made tool on hatstore.co.uk. The information shown in the tool at the time of your order applies.

8.2 By uploading a logo, image or other design, you confirm that you hold all the rights needed for the use you have ordered. If you breach this confirmation, our statutory rights to claim damages are not affected.

8.3 Colours and images in product photos, colour charts and the Custom Made tool simulation may look different on different screens. Your statutory rights (clause 11) are not affected.

8.4 The right to cancel does not apply to contracts for goods that are made to the consumer’s specifications or are clearly personalised.

9 Statutory right to cancel (14 days)

9.1 As a consumer, you have the right to cancel this contract within 14 days without giving any reason.

9.2 The cancellation period ends 14 days after the day on which you, or a third party other than the carrier indicated by you, acquire physical possession of the goods. If your order is delivered in several parts, the period runs from the last delivery.

9.3 To exercise the right to cancel, you must inform us

Hatstore World AB
Resvägen 6
392 41 Kalmar
Sweden
E-mail: customerservice@hatstore.co.uk

of your decision to cancel this contract by a clear statement (for example by e-mail). You can use our cancellation function at hatstore.co.uk/info/right-of-withdrawal, our online returns form at hatstore.co.uk/info/returns-exchanges or the model cancellation form below. You do not have to use the function or the forms.

9.4 If you cancel this contract, we will reimburse all payments received from you, including the costs of delivery, without undue delay and not later than 14 days after the day on which we are informed of your decision to cancel. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

9.5 You must send back the goods or hand them over to us without undue delay and in any event not later than 14 days after the day on which you tell us that you are cancelling. You will have to bear the direct cost of returning the goods. If you use our returns service, the return shipping cost (currently £10) will be deducted from your refund. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

9.6 Exceptions to the right to cancel. The right to cancel does not apply to goods that are made to the consumer’s specifications or are clearly personalised. This applies in particular to our personalised products. The right to cancel also does not apply to sealed goods that are not suitable for return for health protection or hygiene reasons, if they have been unsealed after delivery, for example face coverings. A Mystery Box is a sealed parcel with contents that are not known in advance, sold at a reduced price. The right to cancel also applies to Mystery Boxes, but a Mystery Box must be returned complete with all its contents. As the seal does not need to be broken to examine the goods, opening it counts as handling beyond what is necessary within the meaning of clause 9.5. If the seal has been broken, we will therefore deduct an amount equal to the diminished value of the goods from the refund.

For all other products, the statutory right to cancel under clause 9 remains unchanged.

9.7 Model cancellation form

(Complete and return this form only if you wish to cancel the contract.)

10 Voluntary 100-day right of return

10.1 In addition to the statutory right to cancel under clause 9, we give you a voluntary right to return goods within 100 days of receiving them. Your statutory rights (in particular under clauses 9 and 11) are not affected.

10.2 Conditions for the voluntary right of return:

(a) the goods are unused;

(b) the goods are in their original condition with all original tags and labels;

(c) the right of return does not apply to the exceptions in clause 9.6 (including personalised goods and unsealed face coverings), nor to opened Mystery Boxes or gift cards.

10.3 To return goods under this voluntary right, please use our returns service at hatstore.co.uk/info/returns-exchanges. The goods are returned to our warehouse in Kalmar, Sweden. You pay the return costs; these are currently £10 for standard shipments from the United Kingdom. For particularly large or heavy shipments, the actual costs may differ. The costs that apply to your return are shown in the returns service before each return, so that you can confirm them before booking the return.

11 Your statutory rights

11.1 Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose and as described. If the goods are faulty or do not match the contract, you have the following rights:

(a) Within 30 days of delivery, you can reject the goods and get a full refund.

(b) After that, or if you prefer, you can ask for a repair or replacement. If this is impossible, or a repair or replacement does not fix the problem, you can ask for a price reduction or reject the goods and get a refund, which may be reduced to reflect the use you have had of them.

(c) A fault that appears within six months of delivery is presumed to have existed at delivery, unless we show otherwise. After six months, you may need to show that the fault was present at delivery.

(d) You can make a claim for up to six years after delivery (five years in Scotland).

11.2 We recommend that you report obvious transport damage to the carrier if possible and inform us promptly; however, failing to do so does not affect your statutory rights.

11.3 Colours may vary slightly between screens. If the goods delivered differ from the product description or from what you could reasonably expect, your statutory rights under clause 11.1 apply.

11.4 If we or a manufacturer give you a guarantee in addition to your statutory rights, the terms of that guarantee, which you will find on the product page or in the product packaging, apply. A guarantee does not affect your statutory rights.

12 Liability

12.1 We are liable to you in accordance with the law, and in particular without limitation for:

(a) death or personal injury caused by our negligence or that of our employees or agents;

(b) loss caused by our intentional or grossly negligent breach of duty, or by fraud or fraudulent misrepresentation;

(c) claims under the statutory rules on product liability;

(d) claims under the statutory rules on data protection.

12.2 Otherwise, we are liable in accordance with the general law. Your statutory rights in relation to faulty goods, negligence and other mandatory consumer protection rules are not affected.

13 Data protection

13.1 For information on how we process your personal data, please see our privacy policy at hatstore.co.uk/info/data-protection and our cookie policy at hatstore.co.uk/info/cookies. We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Where required, we ask for your consent to the processing of personal data separately; it is not tied to your acceptance of these terms and conditions.

14 Complaints

14.1 If you have any questions or complaints, you can always contact us at customerservice@hatstore.co.uk. We aim to resolve every complaint directly with you.

14.2 We do not currently use an alternative dispute resolution (ADR) provider. If we cannot resolve your complaint, you can bring a claim in the courts as set out in clause 16.

15 Changes to these terms and conditions

15.1 Contracts already formed are governed by the version of these terms and conditions published at hatstore.co.uk/info/terms-and-conditions at the time of the order.

15.2 Each new order is governed by the version published at hatstore.co.uk/info/terms-and-conditions at the time of that order; you accept it by submitting the order.

15.3 We do not agree with consumers that silence counts as acceptance of changes to these terms and conditions.

16 Governing law and courts

16.1 These terms and conditions are governed by the laws of England and Wales. If you live in Scotland, Scottish law applies; if you live in Northern Ireland, Northern Irish law applies.

16.2 You can bring legal proceedings in the courts of England and Wales, or in the courts of Scotland or Northern Ireland if you live there.
